About these terms
These terms govern your use of this website and the engagement of KL Design & Drafting Pty Ltd ("we", "us") for residential building design and documentation services. A signed fee proposal for a specific project takes precedence over these terms where they differ.
Our services
We provide building design, drafting and documentation for new homes, extensions, renovations, granny flats and small developments, including drawings for DA and CDC submissions. We are building designers, not architects, engineers or certifiers; specialist consultants are engaged separately where required.
Quotes and payment
Quotes are valid for 30 days and cover the scope described in the fee proposal. Work outside that scope, including additional design revisions beyond those included, is quoted separately before proceeding. Invoices are payable within 14 days; council, certifier and consultant fees are payable directly by you unless otherwise agreed.
Client responsibilities
You agree to provide accurate property information, respond to design queries in reasonable time, and obtain any owner or strata consents required for the project. Delays in providing information or approvals may extend project timelines.
Approvals
We prepare documentation to meet the relevant planning controls and lodge applications on your behalf where engaged to do so. Approval decisions rest with councils and certifiers; while we design to maximise the likelihood of approval, we cannot guarantee an outcome or a decision timeframe.
Intellectual property
Drawings and documentation remain our intellectual property. On full payment, you receive a licence to use them for the approved project at the nominated address. They may not be reused for other sites or projects without our written consent.
Liability
We carry professional indemnity insurance and perform our services with due care and skill. To the extent permitted by law, our liability is limited to re-supplying the services or the cost of having them re-supplied. Nothing in these terms limits your rights under the Australian Consumer Law.
